    The Economic Loss Doctrine in Alaska and the Design Professional Exception

    The economic loss doctrine has prevented countless plaintiffs from recovering their economic losses in tort. However, over the last several decades, numerous courts have found exceptions to this doctrine. Alaska currently provides two important exceptions: the independent duty exception and the design professional exception. These two exceptions as applied provide for inconsistent results which create liability for design professionals and cut off liability for non-design professionals. Providing the same approach and analysis for all professionals creates greater consistency and predictability and provides an opportunity for design professionals to limit their exposure to negligence claims

    Effect of a 6-week yoga intervention on swing mechanics during the golf swing:a feasibility study

    Recent evidence suggests that participating in physical conditioning programmes can improve golf performance, however, the effectiveness of a yoga intervention has yet to be investigated. The aim of the current study was to investigate the effectiveness of a six-week yoga intervention on golf swing mechanics. Ten male golfers participated in the laboratory-based-study. Golf swing mechanics were collected from two testing sessions, before and after the six-week yoga intervention, using the Vicon motion capture system. Following the six-week yoga intervention, significant changes were observed between the yoga and control group in X-Factor (P ≤ 0.05) and a medium effect (d ≥ 0.50) observed. No significant changes (P > 0.05) and no effect (d < 0.20) were observed in the X-Factor stretch. Significant changes (P ≤ 0.05) and a medium effect (d > 0.50) were observed for the pelvis rotations following the yoga intervention, however, no differences were observed in torso rotations or hand velocities (P > 0.05). The findings of this feasibility study suggest that yoga may be a promising intervention in helping to improve golf swing mechanics, however, future research is required to confirm the effect of the use of yoga during the golf swing due to the sample size

    Protective Factors Among Postsecondary Students Enrolled in a First-Generation Program

    For generations, researchers have examined attributes that contribute to the adaptability of low socioeconomic youth. Attributes that help one become resilient are known as protective factors. The purpose of this descriptive study was to explore the protective factor(s) that contributed to the enrollment of first-generation, low-socioeconomic status (SES) students at a southern land-grant university. The population consisted of postsecondary students in a First Scholars program during the 2015-2016 academic year. The authors examine the existing literature on the effects of low SES on postsecondary education in order to explore what assists these students in maintaining a steadfast behavior. Recommendations are made for the recruitment of students who display a higher resiliency to be successful at the postsecondary level and for the First Scholars program on how to further enhance the program

    Optimization of the magnetic dynamo

    In stars and planets, magnetic fields are believed to originate from the motion of electrically conducting fluids in their interior, through a process known as the dynamo mechanism. In this Letter, an optimization procedure is used to simultaneously address two fundamental questions of dynamo theory: "Which velocity field leads to the most magnetic energy growth?" and "How large does the velocity need to be relative to magnetic diffusion?" In general, this requires optimization over the full space of continuous solenoidal velocity fields possible within the geometry. Here the case of a periodic box is considered. Measuring the strength of the flow with the root-mean-square amplitude, an optimal velocity field is shown to exist, but without limitation on the strain rate, optimization is prone to divergence. Measuring the flow in terms of its associated dissipation leads to the identification of a single optimal at the critical magnetic Reynolds number necessary for a dynamo. This magnetic Reynolds number is found to be only 15% higher than that necessary for transient growth of the magnetic field.Comment: Optimal velocity field given approximate analytic form. 4 pages, 4 figure

    Spiritual Well-Being Scale: Mental and Physical Health Relationships (Chapter 48 of Oxford Textbook of Spirituality in Healthcare)

    The existence of this handbook documents the recent increase in research on and practical attention to the role of spirituality in healthcare. One essential companion to the concept of spirituality is spiritual well-being (SWB).[1] That is, although the degree and type of spirituality per se can no doubt play an important role in how well a person faces the dilemmas related to health issues,[2,3] the degree to which a person perceives or derives a sense of wellbeing from that spirituality may be equally or more important. In this connection, SWB is an outcome indicator, or barometer, of how well a person is doing in the face of whatever the person is confronting.[4] Therefore, although SWB is not synonymous with spirituality, it is closely related to it. Similarly, SWB is not synonymous with mental health or physical health, but is likely to be related to both of them. SWB connotes one\u27s subjective perception of well-being in both the religious and/or existential dimensions in accord with whatever is implicitly or explicitly conceived of as a spiritual umbrella for the individual. The Spiritual Well-Being Scale (SWBS)* was developed in order to be a tool for self-assessment of these aspects of general perceived well-being. [ 4,5] Since its first publication in 1982, a large body of research has been done with the SWBS. In preparation for writing this chapter, a literature search documented the scale\u27s use in over 300 published articles and chapters, 190 doctoral dissertations and Masters theses, 35 posters and presentations, and 50 unpublished papers. It has also been reprinted in no less than 4 books on palliative care and counseling. [ 6-9] An exhaustive review of all of this research is beyond the scope of this chapter; the interested reader is referred to a companion review article. [ 10] Here, we focus specifically and selectively on research related to healthcare. We highlight those studies using the SWBS that are related to mental health variables or to the mental and well-being issues that are consequences or correlates of physical health conditions. In order to maximize the usefulness of this chapter, it is necessary to ( 1) summarize the intellectual roots of the concept of SWB and what the SWBS does and does not measure, (2) explain the meaning and utility of its religious well-being (RWB) and existential well-being (EWB) subscales, (3) summarize the literature with the SWBS as related to mental and physical health variables, ( 4) note any strengths and weaknesses, research directions, and applications of the SWBS, and (5) summarize implications of SWB research for healthy health care practice

    The effect of movement variability on putting proficiency during the golf putting stroke

    Movement variability has been considered important to execute an effective golf swing yet is comparatively unexplored regarding the golf putt. Movement variability could potentially be important considering the small margins of error between a successful and a missed putt. The aim of this study was to assess whether variability of body segment rotations influence putting performance (ball kinematic measures). Eight golfers (handicap range 0–10) performed a 3.2 m level putt wearing retro-reflective markers which were tracked using a three-dimensional motion analysis system sampling at 120 Hz. Ball roll kinematics were recorded using Quintic Ball Roll launch monitor. Movement (segment) variability was calculated based on a scalene ellipsoid volume concept and correlated with the coefficient of variation of ball kinematics. Statistical analysis showed no significant relationships between segment variability and putting proficiency. One significant relationship was identified between left forearm variability and horizontal launch angle, but this did not result in deficits in putting success. Results show that performance variability in the backswing and downswing is not related to putting proficiency or the majority of ball roll measures. Differing strategies may exist where certain golfers may have more fluid movement patterns thereby effectively utilising variability of movement. Therefore, golf instructors should consider movement variability when coaching the golf putt
